Hammer is dropped on the Gophers

The incident would probably have never been known by anyone who was not there had the female not pressed charges. So if she was embarrassed that she had sex with ten men, why would she make it public? Maybe she knew it was going to spread around campus via the gossip wagon and decided to make charges? Who knows?

But the men involved should be ashamed of themselves. I think Minnesota made the right call


Here's the problem. Following federal rules the woman has months and months to develop her story and tons of strategic and legal resources. Months to practice in front of a mock judge. The judges are schooled in woman issues but nothing for the men. The man gets called into a room and everything is laid on him in a staged setting and without council. For something of this magnitude men should be provided the same resources for the same out of pocket cost.

More troubling is if the school doesn't find against the man with sufficient punishment in the eyes of a prejudiced government the school risks losing funding.

It "could" be that she consented throughout, but at best it isn't clear, especially after the encounter with the first two guys. Even if you find consent with the first two - and it sounds to me like she did, unless she was even more drunk than she said -, after that she was cornered in a room and other guys kept coming in, and I didn't see anything indicating that she asked for more guys to come in, or that there was a lot of discussion about whether she wanted to do anything with the others. Sounded to me like she was probably sexually assaulted after the first two at least.
She was probably, maybe, kinda sexually assaulted? If there's no actual proof that she was assaulted, then there shouldn't be any charges. And there wasn't.

Really? Are you speaking generally or to this specific case?

There were zero criminal charges filed in this case, let alone months and months of mock trials. Considering the event only took place 2 months ago.

The Title IX dept isn't a court, doesn't have judges so I have no idea what the hell this even means.

In this specific case, you have at least 10 members of a football team, who had plenty of time to collaborate a story to discredit anything she said.

As far as resources, I can promise you the players aren't paying for that high priced attorney that is there representing them. You know the one that has promised to sue everyone. I would be willing to say the players will be plenty prepared, when and if this goes to civil trial.

Lastly, there is no requirement to find people guilty to keep federal funding. The only requirement is to have a Title IX office and to investigate situations like this.

Well, I think we have all over analyzed this and beat it to death. I know I have. One of my common points in all of my various posts on the topic though was that these cases are always very, very complicated. And I think it is true in this case as well. None of us knows all of the facts. None of us were there. It is just a sad commentary on how poor decisions can ruin young lives. Whatever happens, I just hope justice prevails, whether that is for this young woman, or for the young men involved.
 
Just wanted to update on the final rulings in this case. 4 of the student athletes were expelled from the university. Two were suspended for a year and 4 were cleared of any wrong doing and have been reinstated.
