College football is just the minor leagues for pro football for many college football players. Once NIL was allowed the genie came out of the bottle and no one can put the genie back in. What I think will happen is the NCAA will eventually go away and then you will see another type governing body take over and then the gloves come off.

The rich will get richer and the poorer will get poorer and "student athletes" as we've always viewed them will no longer be students looking for a degree but rather looking for cash and lots of it. The fact is college football is no longer the game we grew up with and loved, it's a new generation of non traditionist who run the show now like it or not. jmo

Most likely very true BUT what are you going to do constructively about it? Like it or not NIL and the transfer portal are here to stay because there's a new emphasis on giving players their rights driven by the legal system. You can impose more regulations on the process but then how do you enforce them?

It doesn't help the situation that rich schools are raking in the big bucks and coaches getting ever increasing salaries. Players want their piece of that pie.

So what's going to be the enforcement mechanism? Do you have to have an NCAA police force than can cover so many schools? How are you going to prove a school called the parents or players if they don't cooperate? Not arguing for cheating, just pointing out that enforcement isn't that easy to cover so many schools when the perps involved have a mutual motivation to keep it all hidden.

The only thing you could maybe do is to put a clause in the scholarship contract that kids have to sign. Then you might have standing to file a civil suit against the school and the player. At some point it’s going to come about that not only do you have to pay the kid but you have to pay the school you poach him from. Something is going to change and lawyers are going to make a bunch of money

Well, it's a given that lawyers ALWAYS make a bunch of money no matter what the outcome. :)
 
There aren't any rules to enforce.

A coach could go out with his captain to the pre-game coin flip and openly recruit the other teams captains in front of 85,000 fans. It's perfectly fine according to the NCAA.
A little melodramatic, don't you think? NCAA Bylaw 13 prohibits the conduct that constitutes tampering. The issue is getting caught. As someone else mentioned, if these coaches know it's going on, name names and report it to your compliance officer.

They could set up rules where a player has to notify his school if anyone from another program contacts them prior to entering the portal. Same with the schools having to divulge if a player contacts them. Maybe these rules already exist. Then wouldn't it be pretty easy to pretend to be a booster and contact players to see if they take the bait? Not sure it would be easy to pretend to be a in demand player.

BUT how do the coaches prove it's going on if the parties involved keep the tampering to themselves? Coaches can have a lot of suspicions and make allegations but to be able to prove them is another thing. Are the coaches going to wiretap the phones of players and their parents?

Lots of starving lawyers out there trying to keep the lights on. I’ve been both amazed and disappointed by some of the people defended and lawsuits filed by attorneys I’ve known over the years. One guy I consider a friend defended a kid that everybody knew was responsible for the death of his girlfriend. Got him acquitted. Nebraska’s attorney to the stars has defended at least one awful human being because the guy could afford his fee. ☹️ Not going to use his name because I don’t want a defamation suit. ☹️☹️

And what if the players or their parents are initiating the contact with the school because they're fishing for more NIL?

The issue would be collecting evidence. It sure would get interesting if a kid got pissed at his new team’s coach and ratted him out. NIL and the new transfer rules have really opened a can of worms. IMO the transfer rule change is almost more of a problem than NIL.

Is it tampering for a NIL collective to openly state “this is our rate for a successful starting QB”?Pretty much everybody knows before the season is over if a school is looking for a transfer at a specific position for the next season”.

It’s a mess I keep hoping that eventually things will cool off after some schools have problems created by what’s going on.
