Yup, you are making it clear that you think it's ok to drive drunk. Let's try and stick to your idiotic claim that the state just sets an "arbitrary" number. Or do you want to try again? Are there laws that say 70 or older drivers can't drive? I must have missed that one. But then again, I don't make the laws. And if those old people are at a decreased capacity, but still choose to drive? That would be their choice, and judging by your reaction I thought you would be defending them.

I never said " than most".... But if he was conscious, than he was likely in better shape than a good chunk of the Buick Lacrosses I used to see barreling into the hy vee parking lot for breakfast at 6am.

I'm not promoting drinking and driving, but for the state to set an arbitrary number for an illegal BaC is pretty ridiculous
Just give up man. Plain and simple, the kid broke the law and deserves the punishment.

There are no laws against senior citizens driving because of the AARP.... There are no laws against owning handguns because of the NRA.... All this despite thousands of data points showing senior citizens are more likely to kill people on the road, and hand Gun owners are far more likely to shoot themselves or family members than intruders.

Again, I'm not promoting getting drunk and driving.... I'm against laws that seem unconstitutional.
 
If he killed somebody it would be serious, whether he was drinking, texting, chewing sunflower seeds or driving as carefully as possible with two hands on the wheel stone cold sober. But he didn't kill anybody, and at a .015 he is likely still a better driver than a good chunk of the sober population

I have yet to meet a single person who is a.15 or above who can recite the alphabet correctly, let alone drive safely.

At 65 miles per hour, your car is traveling at over 95 feet a second. At a .150, your brains ability to process what it observes is slowed. Facts are facts. I don't care who you are, you are dangerous at .15.

As someone who has seen

A decapitated head from an ejected body striking a cable in mid air

Watched a young lady who had her whole life ahead of her, die in front of my eyes in a crashed car

Saw the aftermath of a wreck that took a a newlywed bride away from her husband,

Seen a car split in 2 when it crashed into a car wash while airborne, and the driver fell out of the car in mid air.

Seen the aftermath of a wreck where Two bodies were thrown through a brink wall

Just to name a few, it makes me shake my head when I hear someone who likely doesn't know what he's talking about, complain about an arbitrary number.

Where in the Constitution does it say you can drink and drive? Where dies it say you can drive? It seems I missed that in my constitutional law classes.

You can drink yourself to death as far as I care. But when you get on a public road, public safety overrides your right to risk the safety of others.

There are ways to deal with elderly drives, and that is comparing apples and oranges.

Wow. You are completely off on your beliefs. I won't destroy your gun claims because this isn't the place. You should stick to believing people should be allowed to drive drunk. You gonna sit back and tell me the alcohol industry doesn't have enough money to make it so people can? You are off your rocker.

And I was riding shotgun in my father in laws Tahoe on HwY 81 when a senior citizen coming the opposite direction came into our lane and drilled us..., his wife died at the scene and my father in law broke several bones in his back. I lucked out and only had to get about 75 stiches.

If they break the law, yes. Is this really that hard? You are usually a sharp guy, but are having a very tough time with this.

No, they lose their license if they fail the test. Usually a criminal traffic offense has already happened which causes the reason for the re-test request.

I could ask what percentage of accidental deaths in this country are from gun accidents, just to start. And then research how many crimes are averted by the presence of a gun on the intended victim. Also could ask what is the percentage that gun murders has gone down in conceal carry states.

I don't want to argue with you because I am 100% behind the 2nd. If I did, I would point out that hand gun owners are far more likely to kill themself or a family member than to use a gun to prevent an active crime.

Btw not all old people suck at driving. I know a couple in their late 70's. Old dude has a 454 SS and isn't afraid to give it some gas once in a blue moon. I'm so jelly. GBR
 
I got a DUI 30 years ago, so I will be sure not to toss a very large rock his way while sitting in my glass family room, but some of these posts reminded me of something that happened just a few short years ago. My buddy and I were coming back from a Colorado-Utah mountain biking trip (& IT WAS AWESOME) and on the way out of Colorado, right around the Sterling area, I had my cruise set on 79, which is of course 4mph over the limit. I got pulled over for it, seriously. Cop just saw two (great looking) guys with mountain bikes in the back and rightfully assumed we were loaded down with drugs and booze so of course so he pulled us over. He ran all my information and walked back to us handing all my stuff back to me and wished us a safe trip home, no ticket, no being a dick, just doing his job. I spout all that to say this, whether it's 4mph over or 40mph, don't get mad at a cop for pulling you over if you're speeding. Initially I was like WTF? Seriously? But after thinking about it, I got it.

If Reilly was going 5mph over, he was putting himself at risk of being pulled over, and if he hadn't been drunk he probably would have gotten off with a warning. Brandon screwed up here, nobody else, and I realize nobody here is blaming anyone else but it seems like there are some posters who can't move past the fact he was "only" speeding by 5mph. I speed by 5 or more when I'm not paying attention to, we all do, just don't bitch when it bites you in the ass.

I do this all the time, set the cruise to 4 mph over. I'm sure it gives police a reason to pull someone over, but if I'm a cop, I'm not bothering the guy doing 4-5 over. The person I am really watching is the one driving exactly the speed limit or slightly under. Those are the ones 'trying too hard' to not get pulled over.

65 mph in a 60 mph zone, lincoln police don't mess around. they don't mess around in blair either.
I once worked with a convict from new orleans, and he was shocked at the speed which lincoln police respond.

That's how I got stopped for mine back in 97 just outside Papillion. The cop that night told me that there were only two types of people out between midnight and 4 am and that was cops and potential drunk drivers.

Around Papillion and La Vista they don't mess around either.Failing to signal a turn more likely threw up the red flag that caught the Police eye.
 
Almost 10am and no stupid post defending drunk idiots from Whiteshoes. Must be sleeping it off.

I get off at 3am and really hope for two things, not to get randomly pulled over and drunk drivers.
