Ok guys I thought I'd come here to the scrolls for some quick legal advice. Gonna call a lawyer tomorrow and possibly set up a meeting but figured I'd see what my fellow RSS'ers knew.
I have a combine for sale and got a call one day from a guy wanting to buy it. He came and looked at it and liked it and he offered me a price for it and I agreed and we shook on it.
He drug his feet for a few weeks after saying he didn't want it. No big deal. Said he was in a bind because he couldn't find enough work for the machine to help pay for it. Well then a little while went by and I decided if it would help make the sell I'd offer up my jobs of custom harvesting to him to seal the deal. He jumped all over it.
Here's where it gets tricky. He shows up and runs my machine over a job I gave him. The whole time I was asking when we could settle up on the deal that way the acres he was cutting would go to him. Technically up to this point he hadn't actually bought the combine. When I would question him about it he said he needed to harvest just enough for the down payment at his bank.
I drew up a bill of sale for the machine with the serial number on it and he signed it and dated it. Then when I got a check for the work he done up to that point I told him I have a check for him to wire to his bank so he could have his down payment. He agreed and so I sent that check.
Now here we are and he has been run off of the job I got him and he still has a payment coming for the latest work he had done. All the sudden now he says he can't buy the machine because he was ran off the job.
Here's my legal question. Am I in good shape to have him by the short hairs because I have his signature on the bill of sale stating that he purchased the combine and I also have proof that I wired money to his bank so he could have his down payment. Also I have his latest check in my hand that would also cover a down payment for the machine.
Please help!!!
