No charges/No arrest

Lancaster County Attorney Joe Kelly said at a Wednesday morning press conference that filing charges "would require proof beyond a reasonable doubt that a crime had occurred. That simply is not there" in this case.

If the State feels it cannot gain a conviction, and that require the State to prove each and every element of the charged offence beyond a reasonable doubt, then the State cannot file a charge.
So how should we feel about this as fans, especially those of us with daughters. I for one am embarrassed.

A bunch of college people were having a party at someone's house until the wee hours of the morning. The police got involved since later in the day someone filed a rape charge. Yes, I assumed alcohol was consumed at the house even though I had no proof of it. What the hell was I thinking?

You asked a question, I answered the question and gave reason to why I've remained quite on the subject. You can attack it all you want, I couldn't care less.
I don't disbelieve that you've heard something with very few degrees of separation to it. That doesn't really alter the outcome. My stance is that I wouldn't trust what anyone says about anything to do with this regardless of who they are. Not saying you're lying, but unless you were standing right there with a video camera, we still can't know if what you were told is what actually happened.

You can show a video of an alleged crime to 5,000 people, and they won't all agree about whether it was a crime or not.

So the closest any of us is going to get to this is to have talked directly to one of the involved parties, and that's still not proof. Is what it is. Weird deal, bad deal.

Doesn't particularly matter for my purposes. With stakes this high, I wouldn't believe anything I didn't see with my own eyes AND hear with my own ears. Too much incentive for stories to be altered, too much subjectivity to when something starts/stops being consensual, etc.

You can't handle actual information. Just information. Got it.

There was no reference I can recall to 6 people. Armstrong was quoted by the OWH that "We had people over" and also said they were "partying". I assume there were at least 5. Regardless, Merriam Webster online dictionary defines "bunch" as "a group of people or things that are together or are associated with each other in some way". The dictionary does not define a numerical value for "group".

Not sure how to take this... What more can be done? The police and DA have weighed in and said, no case. Even if the story is believable, it can't be proven. If there isn't enough evidence to support any action, do we still proceed forward with the prosecution?

I have 3 daughters... I have a junior in high school and twin 8th graders... It scares me to think about what they will face when they get to college. At the same time, it is my responsibility to make sure they understand what the risks are at the college scene. I can only do so much.

If the police and DA have done their job diligently, we have nothing to be embarrassed about. I'm not saying nothing happened, but the authorities can only do so much in the absence of evidence.

Yeah, we don't have enough disagreement to make this interesting. I'm sure you did hear something, and much like the case itself, neither of us could ever prove if what you heard is or is not true, and it wouldn't change the fact that there won't be charges.

Only important question is whether the door is still open for a civil suit.
 
can house parties and accused rape drama be set aside for march 1st thru march 26th?

I'd rather not drama be added to 5-6...5-6 is enough (plenty) drama for now.

I have a 14 year old daughter as well, but we have no names, now no charges, so the only thing we can do now is go Rape Iowa Hawkeyes on live television for everyone to see...yea bad joke im sure...but we will beat Iowa now that we know for sure we have Tommy Armstrong at QB and Westercamp at WR.

Before I give my two cents....I would like to know if it was established for fact that alcohol was involved.

Oh so you WERE in the room and know firsthand what happened? Or is it that you took a sworn affidavit from either the accuser or the accused? Because the only speculating I've done is that however close your source may be, you didn't see it happen, so there's potential for somebody to have been misinformed or to have lied to you. Did you see it happen, Tim?

Because if you think pointing out that a lack of charges is not the same thing as "nothing happened" = speculation on what happened, you need to take the holiday and brush up on your reading comprehension.

The way i see it, Tommy nor Jordan nor our TE (sorry forgot his name) was said to have done this and again no charges are comming, so with that said none of us will ever know who, why or what exactly happened. So anything we ASSume and accuse on Tommy or Jordan is just a simple attempt to ruin a kids life. For all we know, it was some friend if theres that done in there house.
 
Evidence actually, but in all seriousness, is the girl then going to be charged for a wrongful accusation? If there truly is nothing going and I hope there isn't, is she no liable for false reporting?

Is there a code of conduct at Nebraska??? We had an incident like this at the U of Iowa a few years back with Marcus Coker and if I can remember, Coach Ferentz or the U of Iowa suspended him right away from all football activities and he eventually left school. Does Nebraska have a code of conduct rule???

Now, since there are no charges and no one's been named, who's supposed to take the wrap and for what reason? Do you bench TA and JW for keeping a bawdy house?
