Because it's incredibly easy to prove what Mo did. Open and shut, there's the proof right on the phone that he sent a video he should not have possessed by law.
I don't know WTF is so hard for some of you about figuring out that these are two separate crimes and that whether or not the guys raped her has NOTHING to do with Mo's actions being illegal. What he did was a crime regardless of whether the sex was consensual or not.
If some guys rob a bank and then you walk in later and beat one of the tellers then arrested for assault you don't get to go, "OH BUT THE ROBBERS DON'T GET IN TROUBLE???"
Yeah, sort of. I mean...you could argue that it was sent from his phone but that he is not the person that sent it. Super lame argument, I know. But I see HS students use each others phones all the time.
I don't think that is what happend at all I am just saying that is one argument a person could make.
I also think that Greg Brady tried to make a similar argument when this happened.
