Because it's incredibly easy to prove what Mo did. Open and shut, there's the proof right on the phone that he sent a video he should not have possessed by law.

I don't know WTF is so hard for some of you about figuring out that these are two separate crimes and that whether or not the guys raped her has NOTHING to do with Mo's actions being illegal. What he did was a crime regardless of whether the sex was consensual or not.

If some guys rob a bank and then you walk in later and beat one of the tellers then arrested for assault you don't get to go, "OH BUT THE ROBBERS DON'T GET IN TROUBLE???"

Yeah, sort of. I mean...you could argue that it was sent from his phone but that he is not the person that sent it. Super lame argument, I know. But I see HS students use each others phones all the time.

I don't think that is what happend at all I am just saying that is one argument a person could make.

I also think that Greg Brady tried to make a similar argument when this happened.

I am saying consequences, sit down and if he admits to it then he’s out. If he denies he’s suspended until the case resolves and a decision can be made. Furthermore, should 18 year olds not be treated as adults? Obviously prosecutors would treat the two differently as would a judge if convicted based off the facts of the case.
I can agree with that. Some are calling for him to be kicked off instantly and not matter what. There has to be context to understand the situation better. You could go any just about any parents phones and I guarantee you find "child porn" on their phones. According the law it is child porn. When looking at in context it is pictures of their kids playing in the bath. Or running around with their underwear on their heads. It it harmless. The same judgment needs to be taken in this case as well is all I am saying. He should not be branded a sex offender just as no parent should be.

That's one of the worst comparisons I've ever seen. You really just compared intentionally sending a girl a video of what she claims is two dudes raping her with the message "remember this ho(sic)" to parents having pictures of their own children taking a bath.

Does it actually make your head hurt to say something that dumb or does it not have physical side effects?

For all those defending and minimizing this. Your daughter has consented to the video, just like porn actors do and the video gets out. She is under 18, legal age of consent. Look at the law, is it child porn, yes, by the definition of the law

Washington has the video he is no longer under the age of being a minor, he is now an adult who possesses child porn.

Can the sentence be less than the 45 year old collector of porn? Well yes, quite being a f$&$ing fool. The sentences won’t the be same the charges won’t be the same. Good lawd use the sense you keep claiming you have.

If I’m frost based on what’s known so far, suspended from all NU football activities and his only contact with the football team is the tutoring secvices and meal plan but there is someone there with him. Actions have consequences. The suspension lasts until the facts have been fully reviewed, not needed by the public but the university and more importantly law enforcement. Once the decision from law enforcement is set or the school decides the most likely truth of the events, the suspension ends with him being gone or being on the team.

He has already been charged. I don't see much in list of charges that would be different if he were 45 years old.

Do you understand the line ignorance is not a defense? I don’t know by heart the limit for BAC in every state for DUI/DWI laws, if I am traveling for work and get popped for driving drunk is saying I didn’t know you were that strict a legit defense?

The amount of charges in the amount that he possesses. A video vs hundreds of videos. He can be a charge therefore the larger sentence of/when convicted.

No, I don't have an opinion either way. I would hope my child would have the common sense not to be sending nude pics or videos of him or herself, because they should have more respect for themselves. Not to mention that once it's sent it will always be available for public consumption. But kids are going to do things that we have tried to teach them to do otherwise.
 
If she reached out to congratulate him and he made sexual advances and was rebuffed, and responded with the video with the nasty caption, it's time for him to go. It won't be worth the blowback to the university.

Personally I don't think it's cute or cool to have photographs of your naked children either. I think it's weird and uncomfortable when people post that stuff or let their 4-year old run around with his dong out like "LOL isn't it funny he won't keep his pants on." No, it's not funny, I don't want to come to your house any more because I don't want to see your children naked.

I bathe, diaper, and clothe mine until they're old enough to do it themselves because it's my duty as a parent and that's where I like to have just a reeeeeeally clear line drawn.

Well, of course he would be facing more counts if he had more videos. I don't see where that is relevant in the discussion though. The type of charge that he is facing is the same that a 45 year old would face for one video.

Im saying everything needs to be taken into context. Not everything is black and white. You are saying child porn is child porn. He had it so he is automatically guilty and should face the consequences as such. I am simply counter arguing that so could many parents. The law is the law, but context matters too.
Also stay on topic, he isn't being charged with rape. He is being charged with child porn. What is going on int he video is irrelevant. No charges have been filed accusing anyone of rape, but again it really doesn't matter.
Also I haven't insulted you. Try to act like grownup and give me the same respect. I am able to have an adult conversation without going to insults, attempt to do the same.

It happens, but not every kid is doing it, just because you have twisted morals doesnt mean everyone else does. Not every kid is some raging sex addict who cant control their urges, and not everyone is cheap with their body. Your hyperbole is perverted.

What % of high school kids do you think do it? Honestly.

But unfortunately because the laws are written the way they are, what he did might be construed by an aggressive prosecutor as sending child porn. We'll see what actually happens. Unfortunately they are what they are and he did what he did. It's just an extremely stupid unfortunate situation that is going to have some consequences for Washington. I suspect that he might plead guilty to the misdemeanor revenge porn charge in exchange for them dropping the child porn charge. IMO, that would certainly be a logical conclusion but I'm not willing to bet money that a San Francisco prosecutor and judge will be logical.

100%...they were not written with that in mind. It is hard for lawmakers (even though they know that boys ages 13-18 are walking erections and girls ages 13-18 want to be validated) to include the realities of what goes on.

Scary fact for Mo, if the video actually was of her being abused sexually (TBD) and he sent it over the internet/cell network this could extend to federal jurisdiction and he could technically face up to a life sentence in prison under federal law.

I really doubt the video actually was of her being assaulted. I mean, the police and the school saw the video and ultimately expelled her from school and no charges for SA or rape were brought forward.
